Welcome to STIIICKS™. The terms “we”, “us” and “our” refer to STIIICKS™ operated by SCENT TROPEZ AB (“STIIICKS”). We operate this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the “Services”). Our store is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service (“Terms”), together with any policies referenced herein, describe your rights and responsibilities when you use the Services.

Please read these Terms carefully. By visiting, interacting with or using our Services, you agree to be bound by these Terms and our Privacy Policy: Here. If you do not agree, do not use the Services.

SECTION 1 – ACCESS AND ACCOUNT

You represent that you are at least the age of majority in your place of residence, or that you have consent to allow any minor dependents to use the Services on devices you own, purchase or manage.

To use the Services, including placing an order, you may be asked to provide information such as your email address, billing, payment, and shipping information. You represent and warrant that all information you provide is accurate, current and complete and that you have all rights necessary to provide it.

You are responsible for maintaining the confidentiality of any account credentials and for all activity under your account. You may not transfer, sell, assign, or license your account to another person.

SECTION 2 – OUR PRODUCTS

We make every effort to present products as accurately as possible. However, product colors and appearance may vary depending on your device settings and display.

Product descriptions, availability and pricing may change at any time without notice, at our sole discretion. We reserve the right to discontinue products and to limit quantities per order, per customer, or per region.

SECTION 3 – ORDERS

When you place an order, you make an offer to purchase. We may accept or decline an order at our discretion. An order is considered accepted when we confirm it and payment has been authorized and processed.

Please review your order carefully before submitting. Once an order has been accepted, we may not be able to accommodate cancellation or changes.

If we cancel or change an order, we will attempt to notify you using the email address and other details provided at checkout.

SECTION 4 – PRICES AND BILLING

Prices are shown in the currency presented in the store and may change without notice. The price charged will be the price shown at checkout at the time of purchase.

Unless otherwise stated, prices include applicable VAT for orders within the EU where required. Shipping costs are shown at checkout before you confirm your purchase. Customs fees or import charges may apply for deliveries outside the EU and are the customer’s responsibility.

You agree to provide current, complete and accurate purchase and payment information and to promptly update information if it changes.

SECTION 5 – SHIPPING AND DELIVERY

Estimated delivery times are estimates only and not guaranteed. We are not responsible for delays caused by carriers, customs, or events outside our control.

Risk of loss passes to you when the order is handed over to the carrier, unless otherwise required by mandatory consumer law.

If a package is returned to us because the address details were incomplete or incorrect, or because it was not collected in time, you may be responsible for additional shipping costs to re-ship.

SECTION 6 – RIGHT OF WITHDRAWAL (EU CONSUMER RIGHT)

If you are a consumer in the EU/EEA, you normally have a 14-day right of withdrawal from the day you receive your goods, in accordance with EU consumer law.

To exercise your right of withdrawal, you must notify us within 14 days of receiving your order. You then have 14 days to return the goods.

Goods must be returned unused, in original condition, and in original packaging to qualify for a full refund. You are responsible for return shipping costs unless we state otherwise in our Refund Policy.

Refunds are processed once the return is received and inspected. Refunds are made to the original payment method.

SECTION 7 – COMPLAINTS AND LEGAL GUARANTEE (SWEDEN/EU)

If you are a consumer, you have statutory rights under applicable consumer protection laws.

For customers in Sweden, you have the right to complain about a faulty product in accordance with the Swedish Consumer Sales Act (Konsumentköplagen). Complaints must be made within a reasonable time after you noticed the defect. You may have rights to repair, replacement, price reduction, or refund depending on the case.

SECTION 8 – RETURNS POLICY

Returns, exchanges and refunds are governed by our Refund Policy: Here. If there is any conflict between these Terms and the Refund Policy, the Refund Policy applies to returns and refunds.

SECTION 9 – INTELLECTUAL PROPERTY

All content on the Services, including but not limited to trademarks, logos, product names, text, graphics, images, videos, and the design and arrangement thereof, is owned by or licensed to STIIICKS and is protected by applicable intellectual property laws.

You may use the Services for personal, non-commercial use only. You may not copy, reproduce, distribute, modify, create derivative works from, or exploit any part of the Services without our prior written permission.

SECTION 10 – OPTIONAL TOOLS AND THIRD-PARTY SERVICES

We may provide access to third-party tools or services which we do not control. These are provided “as is” and “as available” without warranties or endorsements. Your use of third-party tools is at your own risk.

The Services may contain links to third-party websites. We are not responsible for third-party content, policies, or practices. Accessing third-party sites is at your own risk.

SECTION 12 – RELATIONSHIP WITH SHOPIFY

STIIICKS is powered by Shopify, which enables us to provide the Services. Any purchase you make is made directly with STIIICKS, not Shopify. You acknowledge and agree that Shopify is not responsible for any aspect of sales between you and STIIICKS, including any injury, damage, or loss resulting from products purchased. You expressly release Shopify and its affiliates from any claims related to your purchases from STIIICKS.

SECTION 13 – PRIVACY AND DATA PROTECTION

Because the Services are hosted by Shopify, Shopify may process personal data as part of providing the Services. Personal data may be transferred outside your country, including outside the EU/EEA, with appropriate safeguards as required by law.

SECTION 14 – FEEDBACK AND USER CONTENT

If you submit feedback, reviews, ideas, or other content (“Feedback”), you grant us a worldwide, perpetual, sublicensable, royalty-free right to use, reproduce, modify, publish, distribute and display such Feedback for any lawful purpose, including marketing, unless prohibited by law.

We may cancel orders if any information is inaccurate or fraudulent.

To the fullest extent permitted by law, STIIICKS, its affiliates, partners, directors, officers, employees, contractors and service providers shall not be liable for indirect, incidental, special, consequential or punitive damages, including lost profits, lost revenue, loss of data, or replacement costs, arising from your use of the Services or products.

Nothing in these Terms limits liability where such limitation is not permitted by applicable mandatory consumer law.

SECTION 20 – INDEMNIFICATION

You agree to indemnify and hold harmless STIIICKS and Shopify (and their affiliates and service providers) from any claims, liabilities, damages, and expenses arising from your breach of these Terms, your violation of laws, or your misuse of the Services.

SECTION 21 – SEVERABILITY

If any provision of these Terms is held unlawful or unenforceable, the remaining provisions remain in full force and effect.

SECTION 22 – ENTIRE AGREEMENT

These Terms and the policies referenced form the entire agreement between you and STIIICKS regarding your use of the Services, and supersede prior agreements or communications.

SECTION 23 – GOVERNING LAW AND DISPUTES

These Terms are governed by the laws of Sweden, without regard to conflict of law principles.

If you are a consumer in Sweden and you have a dispute with us, you may contact Allmänna reklamationsnämnden (ARN) for alternative dispute resolution. More information is available at arn.se.

If a dispute cannot be resolved, it may be settled by a competent court in Sweden. If you are a consumer, you may also have the right to bring claims in your local court under mandatory consumer rules.

SECTION 24 – CHANGES TO TERMS

We may update these Terms from time to time by posting a new version on the website. Changes apply from the date they are posted, unless otherwise required by law.
